What if the other parent does not consent to my relocation?
Under Pennsylvania law, a parent who plans to relocate with his or her child must file with the Court a Noticed of Proposed Relocation. The relocating parent must also serve the Notice to the other party via certified mail at least 60 days in advance (or 10 days in cases of true emergencies). The Notice must detail information regarding the proposed relocation. The non-relocating parent then has 30 days to file a written objection with the Court. Can I move if the other parent consents to my relocation?
Yes, but we recommend memorializing your agreement in a formal Consent Order and processing it with the Court. If you do not obtain a written agreement, it’s possible the other parent could later claim he or she did not agree to your relocation. The Court has the authority to issue an Order to bring the child back, or even issue an Order modifying the physical custody schedule. It depends.
